Error: At page 4, finding 1, the Zoning Administrator made the finding that the establishment, maintenance, and operation of the proposed kindergarten through twelfth grade school and child care facility uses will not, under the circumstances of this case, be considered detrimental to the public health, safety, peace, morals, comfort, or general welfare of persons residing or working in the neighborhood. In fact, numerous neighbors testified to the detriment sustained to their peace, comfort, and general welfare based on the operation of the school at its current level of 40 students. The testimony of the supporters of the project acknowledged noise concerns and blamed residents for having purchased homes near a church. Despite the testimony of the residents to the disturbance caused by the current 40 students, the use permit granted an increase in the number of students of over 50% immediately, with an automatic increase to 80 students, doubling the size of the school within less than a year. This will create an intolerable nOise/traffic situation for the neighbors. 2. AODlicant's Lack of Cometiance with Ree:ulatlons/Conditions to Date: There are numerous conditions imposed upon the applicant for the approved use permit. Those of us who have resided ~~~r the applicant's operation for the past 2 years know that conditions imposed have rarely, ifever, been followed by the applicant. The project file maintained at the Planning Commission is replete with evidence of the applicant's failure to cooperate with requests, provide information, or follow the rules set forth by the City. At the time of the public hearing, they had still not complied with all the request s for information or action by the city. To grant the instant permit, to an applicant who has flaunted all of the rules and regulations applicable to the rest of Redwood City residents, is incomprehensible.
