Ward and MaryAnn Clifford are filing this appeal with the support of several <br />local neighbors. The main contact for any correspondence should be Dawn M. Ward, 1095 Connecticut <br />Drive, Redwood City, CA 94061. . <br /> <br />Grounds for the AeDeal <br /> <br />1. The Use Permit Findin2s are In. Error: At page 4, finding 1, the Zoning Administrator made the <br />finding that the establishment, maintenance, and operation of the proposed kindergarten <br />through twelfth grade school and child care facility uses will not, under the circumstances of this <br />case, be considered detrimental to the public health, safety, peace, morals, comfort, or general <br />welfare of persons residing or working in the neighborhood. <br /> <br />In fact, numerous neighbors testified to the detriment sustained to their peace, comfort, and <br />general welfare based on the operation of the school at its current level of 40 students. The <br />testimony of the supporters of the project acknowledged noise concerns and blamed residents <br />for having purchased homes near a church. <br /> <br />Despite the testimony of the residents to the disturbance caused by the current 40 students, the <br />use permit granted an increase in the number of students of over 50% immediately, with an <br />automatic increase to 80 students, doubling the size of the school within less than a year. This <br />will create an intolerable nOise/traffic situation for the neighbors. <br /> <br />2. AODlicant's Lack of Cometiance with Ree:ulatlons/Conditions to Date: There are numerous <br />conditions imposed upon the applicant for the approved use permit. Those of us who have <br />resided ~~~r the applicant's operation for the past 2 years know that conditions imposed have <br />rarely, ifever, been followed by the applicant. The project file maintained at the Planning <br />Commission is replete with evidence of the applicant's failure to cooperate with requests, <br />provide information, or follow the rules set forth by the City. At the time of the public hearing, <br />they had still not complied with all the request s for information or action by the city. To grant <br />the instant permit, to an applicant who has flaunted all of the rules and regulations applicable to <br />the rest of Redwood City residents, is incomprehensible. <br /> <br />Appeal of Notice of OffiCia,l Action from 2/9/09 -1 <br />
