<br />Amendment to an Agreement for Professional Environmental Consulting Services for the Laurel
<br />Way Environmental Impact Report
<br />
<br />ReCOMMENDATION
<br />Approve by motion Amendment No.1 to the Agreement with MHAlRMT, Inc., to prepare an
<br />Environmental Impact Report (EIR) for the Laurel Way project.
<br />
<br />BACKGROUND
<br />The Laurel Way Joint Venture, which is comprised of 18 of the 19 property owners who own
<br />vacant parcels on Laurel Way, is proposing to develop the remaining undeveloped 18 parcels
<br />with individual single family homes. The project site is approximately 5.1 acres.
<br />
<br />Per City Council policy, staff has required that an Environmental Impact Report (including all
<br />necessary technical studies) be prepared prior to any new development on the western end of
<br />Laurel Way. The EIR will examine the full build-out of the street, and provide comprehensive
<br />information (engineering, geology, biology, and other studies) necessary to guide development
<br />on Laurel Way. A developer has also filed applications for a Planned Development Permit, and
<br />a Tentative Subdivision Map for the project. The City executed the original agreement for the EIR
<br />(Attachment 1) for $159,812 (plus $15,912 contingency fund). Execution of Amendment No.1 is
<br />now needed to cover additional work including attending extra meetings, data gathering and data
<br />requests in order to support the applicant, in the amount of $46,863.001. The applicant has
<br />agreed to this modification.

<br />A brief history of this Agreement and associated amendments is summarized below:
<br />
<br />. April 14, 2008: Original Agreement for $159,812.00 (plus 10 percent contingency fund).
<br />. May 2009: Proposed Amendment NO.1 submitted for $46,863.00 to complete the
<br />Environmental Impact Report.
<br />. . To date, the EIR consultant and contract planner/staff have completed the following tasks:
<br />o Drafted a project description and definition;
<br />o Conducted additional peer reviews;
<br />o Prepared and analyzed technical reports; and,
<br />o Prepared impact sections of the EIR (Le. cultural resources, hydrology, noise and
<br />traffic) .

<br />For a comprehensive list of completed and pending tasks, please refer to MHAlRMT's letter
<br />dated May 26, 2009 (Attachment 2).
<br />
<br />1 Originally, the budget amendment was proposed at $72,640. However, that amount was reduced by $10,696
<br />by the EIR consultant at the direction of staff. The reduction, plus use of the project's existing contingency fund
<br />reduces the requested budget augment to $46,863.00.
