<br />lighting poles and standards, handicapped access ramps, <br />construction of tree wells and planting of trees. Participant <br />shall obtain any and all necessary approvals prior to the <br />commencement of applicable portions of said construction, and <br />Participant shall take reasonable precautions to ensure the safety <br />and stability of surrounding properties during said construction. <br /> <br />p. Participant shall begin and complete all <br />construction and development and undertake all obligations and <br />responsibilities of Participant within the times specified in the <br />Schedule of Performance, or within such reasonable extensions of <br />such times as may be granted by the Agency and the City, or as <br />otherwise provided for in this Agreement. The Schedule of <br />Performance may be revised from time to time as mutually agreed <br />upon in writing by and among the Parties. Any and all deadlines <br />for performance by the Parties shall be extended for any times <br />attributable to delays which are not the fault of the performing <br />party and are caused by another party. <br /> <br />q. Prior to and during the period of construction of <br />the Project, Participant shall submit to the Agency and the City <br />written progress reports when and as reasonably requested by the <br />Agency and the City but in no event more frequently than once every <br />month. The reports shall be in such form and detail as may <br />reasonably be required by the Agency and/or the City, and shall <br />include a reasonable number of construction photographs taken since <br />the last such report submitted by Participant. <br /> <br />r. Prior to the commencement of construction on any <br />portion of the Property, Participant shall furnish, or shall cause <br />to be furnished, to the Agency and/or the City duplicate originals <br />or appropriate certificates of public indemni ty and liabili ty <br />insurance in the amount of Two Million Dollars ($2,000,000.00) <br />combined single limit, naming the Agency and the City as additional <br />insureds. Said insurance shall cover comprehensive general <br />liability including, but not limited to, contractual liability; <br />acts of subcontractors; premises-operations; explosion, collapse <br />and underground hazards, if applicable; broad form property damage, <br />and personal injury including libel, slander and false arrest. In <br />addition, Participant shall provide to the Agency and/or the City <br />adequate proof of comprehensive automobile liability insurance <br />covering owned, non-owned and hired vehicles, combined single limit <br />in the amount of Two Million Dollars ($2,000,000.00) each <br />occurrence; and proof of workers' compensation insurance. <br />Participant shall also provide proof of property-fire insurance for <br />the replacement value of the improvements constructed in connection <br />wi th the Proj ect. Any and all insurance policies required <br />hereunder shall be obtained from insurance companies admitted in <br />the State of California and rated at least B+: XII in Best' s <br />Insurance Guide. All said insurance policies shall provide that <br />they may not be canceled unless the Agency and the City receive <br /> <br />10 <br />
