<br />comply with the City's affirmative marketing plan for the HOME <br />Units, to be provided by the City. The HOME Units shall be further <br />subject to the marketing requirements for HUD Section 811 Occupancy <br />Requirements for supportive housing for persons with mental health <br />disabilities as follows: <br /> <br />i. Affirmative marketing to ethnic groups <br />least likely to be served; and <br /> <br />11 . Open marketing to very low income <br />individuals with a mental illness. <br /> <br />Except for existing tenants, Participant shall, to <br />the extent permitted by applicable law, select eligible tenants for <br />the HOME Units from a pool of applicants residing in the <br />incorporated limits of the City no later than the date on which <br />construction will begin or the earliest date a unit is habitable <br />for occupancy. <br /> <br />Participant shall be responsible for identifying a <br />pool of qualified applicants to fill the HOME Units. At the <br />election of the Participant, Participant may consult with the City <br />to ensure that Participant has a sufficient pool of qualified <br />applicants from which to fill the HOME Units. <br /> <br />4. Lobbying Prohibited. Participant shall not use <br />HOME funds for publicity or propaganda purposes designed to support <br />or defeat legislation pending before federal, state, or local <br />government. HOME funds shall not be used by Participant to <br />influence an officer or employee of any agency, a Member of <br />Congress, and officer or employee of Congress, or an employee of a <br />Member of Congress in connection with the award of any Federal <br />contract. <br /> <br />5. Additional HUD Section 811 Requirements. <br />Participant acknowledges and agrees that in conjunction with the <br />use of HUD Section 811 funds, the terms and conditions of the HUD <br />provisions Rider attached hereto as Exhibit "G" and incorporated <br />herein by this reference shall be applicable to the Project, and <br />Participant agrees to comply with the requirements thereof. <br /> <br />Section 4.02. Maintenance of the Property. <br /> <br />Participant covenants and agrees for itself, its <br />successors, its assigns, and every successor in interest to any <br />portion of the Property, that Participant, such successors and such <br />assigns shall maintain in good condition the improvements on the <br />Property, shall keep the Property free from any accumulation of <br />debris or waste material, subject to normal construction job-site <br />conditions, and shall maintain in a neat, orderly, healthy and good <br />condition the landscaping required to be planted in accordance with <br /> <br />23 <br />
