<br />v. Very low Income, as that term is defined <br />by California Health and Safety Code <br />section 50105, and not exceeding 50% of <br />Area Median Income (excepting the <br />manager's uni t) . <br /> <br />(c) Marketing of HOME Units. Declarant shall comply <br />with the City's affirmative marketing plan for the HOME Units, to <br />be provided by the City. The HOME Units shall be further subject <br />to the marketing requirements for HUD Section 811 Occupancy <br />Requirements for supportive housing for persons with mental health <br />disabilities as follows: <br /> <br />l. Affirmative marketing to ethnic groups <br />least likely to be served; and <br /> <br />ii. Open marketing to very low income <br />individuals with a mental illness. <br /> <br />Except for existing tenants, Declarant shall, to the <br />extent permitted by applicable law, select eligible tenants for the <br />HOME units from a pool of applicants residing in the incorporated <br />limits of the City no later than the date on which construction <br />will begin or the earliest date a unit is habitable for occupancy. <br /> <br />Declarant shall be responsible for identifying a <br />pool of qualified applicants to fill the HOME Uni ts.' At the <br />election of the Declarant, Declarant may consult with the City to <br />ensure that Declarant has a sufficient pool of qualified applicants <br />from which to fill the HOME units. <br /> <br />(d) The foregoing covenants shall not be deemed to <br />supersede any affordability covenants against the Property which <br />require that the units of the Property be made available to persons <br />of lower income levels than provided herein, but shall apply if <br />there are no covenants which are more restrictive which apply to <br />the Property. <br /> <br />4. Lobbying Prohibited. Declarant shall not use HOME <br />funds for publicity or propaganda purposes designed to support or <br />defeat legislation pending before federal, state, or local <br />government. HOME funds shall not be used by Declarant to influence <br />an officer or employee of any agency, a Member of Congress, and <br />officer or employee of Congress, or an employee of a Member of <br />Congress in connection with the award of any Federal contract. <br /> <br />EXHIBIT ~C" - Page 5 <br />
