<br />practice or practices of discrimination or segregation with <br />reference to the selectionl locationl number I use or occupancy <br />of tenants I lesseesl subtenants I sublesseel or vendees in the <br />premises herein conveyed. The foregoing covenants shall run <br />wi th the land. II <br /> <br />uNotwithstanding the immediately preceding <br />paragraph I with respect to familial statusl the immediately <br />preceding paragraph shall not be construed to apply to housing <br />for older persons I as defined in Section 12955.9 of the <br />Government Code. with respect to familial status I nothing in <br />the immediately preceding paragraph shall be construed to <br />affect Sections 51.2'1 51.31 51.4, 51.10, 51.111 and 799.5 of <br />the Civil Code, relating to housing for senior citizens. <br />Subdivision (d) of Section 51 and Section 1360 of the Civil <br />Code and subdivisions (n), (0) and (p) of Section 12955 of the <br />Government Code shall apply to the immediately preceding <br />paragraph." <br /> <br />The foregoing provisions shall be binding upon and shall <br />obligate the contracting party or parties and any <br />subcontracting party or parties, or other transferees under <br />the instrument. <br /> <br />(d) After the satisfactory completion of the Project in <br />compliance with the OPA, the Property shall be devoted to the uses <br />specified in the OPA, consistent with the Redevelopment Plan and <br />shall not, in whole or in partl be devoted to any other use or used <br />for any other purposes except as may be approved by the Agency in <br />writing in advance. This covenant shall remain in effect for the <br />longer of the life of the Redevelopment Plan, as extended from time <br />to time, or the end of the term of the Affordability Covenants as <br />provided in the following paragraph. <br /> <br />(e) The Property shall be subject to the Declaration of <br />Affordability Covenants recorded upon the Property, which shall <br />remain in effect for a period of fifty-five (55) years from the <br />date of recordation of the Certificate of Completion for the <br />Property (the uAffordability Covenants"). <br /> <br />(f) Section 504 of the Rehabilitation Act of 1973 <br /> <br />(1) Pursuant to Section 514 (Public Law 93-112), <br />Declarant agrees that no otherwise qualified persons with <br />disabilities shall, solely by reason of a disability, be excluded <br />from the participation in, be denied benefits of, or be subjected <br />to discrimination in the performance of the Agreement or in the <br /> <br />EXHIBIT ~D"-PAGE 5 <br />
