<br />e. Agency Assistance Funding Procedure. Subject to the <br />other provisions contained herein, including, without limitation, <br />the condi tions precedent set forth above, the proceeds of the <br />Development Grant and the Fee Subsidy shall be disbursed to <br />Participant upon a schedule mutually agreeable to the Parties. <br /> <br />Section 2.02. City Assistance. <br /> <br />The Parties acknowledge and agree that the City <br />previously provided certain monetary assistance in an amount equal <br />to Seven Hundred Forty-Eight Thousand, Four Hundred Ninety-Three <br />Dollars and Sixty-Seven Cents ($748,493 .67) to Participant in <br />conjunction with Participant's acquisition of the Property (the <br />~City Assistance") . <br /> <br />Section 2.03. Land Use and Environmental Approvals. <br /> <br />Participant must obtain any and all necessary land use <br />approvals or changes required for the Project, including, without <br />limitation, general and special plan amendments, conditional use <br />permits required pursuant to applicable zoning ordinances, any and <br />all modifications or variances including, but not limited to, those <br />modifications or variances necessary for height, parking, signs and <br />any and all other matters. The Agency and the City require that <br />all requirements of the California Environmental Quality Act <br />(~CEQA") and the National Environmental Policy Act (~NEPA") <br />applicable to this Agreement and the Proj ect, shall be met. <br />Participant shall apply for all necessary environmental permits or <br />clearances applicable to the Project. <br /> <br />ARTICLE III <br /> <br />DEVELOPMENT OF THE SITE <br /> <br />Section 3.01. Development by Participant. <br /> <br />a. The Parties agree that Participant shall develop the <br />Property within the times specified in the Schedule of Performance, <br />attached hereto as Exhibit ~E" and incorporated herein by reference <br />(the ~Schedule of Performance"), as a multi-unit affordable <br />supportive housing project, consisting generally of fifteen (15) <br />rental apartments, including one (1) manager's unit, parking and <br />ameni ties, all as more specifically described in the Scope of <br />Development.
