<br />REPORT <br /> <br />6.1A <br />age 1 <br /> <br /> <br />July 27, 2009 <br /> <br />SUBJECT <br />Appeal of the Zoning Administrator's Approval of a Use Permit for Woodside Hills <br />Christian Academy at 2323/2325 Euclid Avenue <br /> <br />RECOMMENDATION <br />Deny the appeal and modify the Zoning Administrator's decision, thereby altering the <br />student capacity of Woodside Hills Christian Academy by confirming the alternative <br />language provided in the Revised Notice of Official Action. <br /> <br />BACKGROUND <br />Per the direction provided by the City Council at the July 13, 2009 public hearing <br />regarding the appeal of the Zoning Administrator's approval of the Use Permit for the <br />Woodside Hills Christian Academy project, staff revised the Notice of Official Action as <br />follows: <br /> <br />. The overall student capacity was reduced from a maximum overall student capacity <br />of 80 students to a maximum of 50 students for the 2009-2010 school year. <br />. Following the 2009-2010 school year, any subsequent increase beyond 50 students <br />and no more than 80 students would be contingent upon full compliance with all of <br />the conditions of approval set forth in the Revised Notice of Official Action. <br />. The applicant would be required to check-in with the City every six (6) months to <br />verify student enrollment and provide updates on the required property <br />improvements as outlined in the conditions of approval until the applicant <br />demonstrates full compliance with all of the conditions of approval. Additional <br />check-ins may be required as deemed necessary by the Zoning Administrator to <br />verify compliance with said conditions. <br /> <br />For full details regarding these changes, please refer to Use Permit Findings No. 1 on <br />pg. 4, and Conditions of Approval Nos. 13 and 14 on pgs. 6 and 7 of the Revised Notice <br />of Official Action (Attachment 1). <br /> <br />ALTERNATIVES <br />. Provide additional edits to the Revised Notice of Official Action as deemed <br />appropriate. <br /> <br />FISCAL IMPACT <br />There are no anticipated fiscal impacts associated with this Council action. <br />
