REPORT 6.1A age 1 July 27, 2009 SUBJECT Appeal of the Zoning Administrator's Approval of a Use Permit for Woodside Hills Christian Academy at 2323/2325 Euclid Avenue RECOMMENDATION Deny the appeal and modify the Zoning Administrator's decision, thereby altering the student capacity of Woodside Hills Christian Academy by confirming the alternative language provided in the Revised Notice of Official Action. BACKGROUND Per the direction provided by the City Council at the July 13, 2009 public hearing regarding the appeal of the Zoning Administrator's approval of the Use Permit for the Woodside Hills Christian Academy project, staff revised the Notice of Official Action as follows: . The overall student capacity was reduced from a maximum overall student capacity of 80 students to a maximum of 50 students for the 2009-2010 school year. . Following the 2009-2010 school year, any subsequent increase beyond 50 students and no more than 80 students would be contingent upon full compliance with all of the conditions of approval set forth in the Revised Notice of Official Action. . The applicant would be required to check-in with the City every six (6) months to verify student enrollment and provide updates on the required property improvements as outlined in the conditions of approval until the applicant demonstrates full compliance with all of the conditions of approval. Additional check-ins may be required as deemed necessary by the Zoning Administrator to verify compliance with said conditions. For full details regarding these changes, please refer to Use Permit Findings No. 1 on pg. 4, and Conditions of Approval Nos. 13 and 14 on pgs. 6 and 7 of the Revised Notice of Official Action (Attachment 1). ALTERNATIVES . Provide additional edits to the Revised Notice of Official Action as deemed appropriate. FISCAL IMPACT There are no anticipated fiscal impacts associated with this Council action.
