However, if the City Council upholds <br /> the Planning Commission's denial of the project, the praject may be exempted <br /> from CEQA and the Committee's appeal wi11 be moot. <br /> As to the timefiness of the Committee's ap�eal, the attached documents <br /> attest to the fact that Committee representative Daniei Ponti contacted City staff <br /> before filing the appeal o#the Negative Declaration. Tom Passanisi courteously <br /> explained via emai� that the appeal would need to be submitted to the City Clerk <br /> within seven days of the "Notice of Official Action" that wou�d likely be released <br /> the following day.
