Motion failed 1-6 with Council Member Hartnett in favor and all others opposing.
Mr. Yamamoto provided information what a motion to deny the appeal means. Mr. Lyon
referred to page 19 of the staff report on condition #13 and #14. One suggestion was to
deny the appeal and alter the zoning administrators conditions imposed.
Motion by Vice Mayor Howard to deny the appeal, alter the Zoning Administrators' decision
regarding the conditions, and having the student capacity at a maximum of 50 students.
This includes placing a term of a one year on the use permit with a one year review and
having quarterly updates and a point person to connect with the neighbors and staff.
Motion died for lack of a second.
Mr. Yamamoto explained some of the complexities around the expiration of a use permit.
City Manager Ingram provided clarification on condition #10 of page 19 and 17 of the staff
report. Council discussed what is on the permit and what it should say regarding the dates
and numbers. City Attorney Yamamoto spoke about the issue of reporting the number of
enrollees and Mr. Lyon said this could be asked of the applicant.
M/S Hartnett/Pierce motion of intent to deny the appeal, issue the permit modified to
include school capacity starting at 50 students going up to 80 students, and having the
school provide semi-annual reports to staff. The modified permit to come back to City
Council for final approval.
Vice Mayor Howard shared her concerns with the 80 and she would prefer 65 students as
a compromise. Mr. Lyon clarified the applicant will not get off the 50 students until the
trust is built back and then the Zoning Administrator may consider the incremental
increases.
Motion carried unanimously by electronic vote. Minute Order 09-151
Mayor Foust thanked the neighbors and the community.
(Council discussed the Woodside Hills Christian Academy mater between 8:55 p.m. and 11:25
p.m. For the full content of the discussion please view the archived web stream for the meeting of
07/13/09 at http://www.redwoodcitv.orq/qovernment/council/aqendas/2009/mov 090713.html and
please select the correct agenda item 8.C).
Council took a break at 11:25 p.m. and resumed at 11:35 p.m.
D. Appeal of Zoning Administrator's Approval of a Use Permit for a massage service
establishment at 515 Woodside Road.
Recommendation:
By motion, deny the appeal, thereby upholding the decision of the Zoning
Administrator, based on findings as documented in the Notice of Official Action, to
allow a massage service establishment at 515 Woodside Road.
Mr. Mehra, Associate Planner, presented a brief staff report on the appeal. He
covered the options before Council. He also provided a site review (presentation
on file).
