Motion carried unanimously by voice <br /> vote. <br /> M/S Pierce/Hartnett to extend the meeting to 12:30 a.m. Motion carried <br /> unanimously by voice vote. <br /> Council discussed the matter bringing up various issues and concerns related to <br /> traffic, neighborhood safety and possible hours of operation. <br /> M/S Pierce/Hartnett to extend the meeting to 12:45 a.m. Motion carried <br /> unanimously by voice vote. <br /> City Attorney Yamamoto answered questions related to Assembly Bill 731. The <br /> Council further discussed hours of operation, looking at the lighting in the area <br /> possibly studying speed bumps, and other traffic control measures. One Council <br /> Member said that limiting the business hours might make it difficult for the business. <br /> M/S Howard/Pierce to extend the meeting to 1:30 a.m. <br /> M/S Aguirre/Ira to deny the appeal, modifying the decision of the ZA based on the <br /> findings and include the other items that need to be modified. Mayor Foust does <br /> not support this action because of the General Plan process and how she believes <br /> more needs to be done on studying uses in the area. She proposed a six day <br /> business week with 8-6 hours and Saturday 8-4 but she could not support the <br /> motion. <br /> Vice Mayor Howard said that she has concerns with the safety and the lighting in <br /> the area. Council Member Pierce will support the motion if it includes the lighting <br /> and the other items brought up. Council Member Aguirre confirmed that she would <br /> include the lighting, consideration of traffic calming measures on Murray Court, and <br /> parking issues on the motion. The second of the motion agreed with the additional <br /> items. Motion failed by electronic vote 2-5 with Aguirre and Ira affirmative and <br /> all others opposing. <br /> Motion by Council Member Pierce to deny the appeal, grant the use permit and <br /> modify the conditions of approval subject to addressing the parking, hours of <br /> operation and attaching other conditions to come back to Council for review. Mr. <br /> Lyon and City Attorney Yamamoto provided some information on the current <br /> condition. The motion was withdrawn by the maker and another motion was made. <br /> Comments were made about restricting the hours and limiting the life of the Use <br /> Permit. <br /> M/S Howard/Pierce to defer the decision and continue the item to whenever staff <br /> can bring it back and have staff look at the issue of hours of operation as well as <br /> the life of the Use Permit.
