Creek Setback <br /> • Legitimate concern about precedent : <br /> Commissioner Cronin, 5/19: <br /> "Most of my comments have a tone of concern. 1've had an opportunity — been <br /> on this Planning Commission for about 6 years and so one of the things 1 was <br /> very proud of was being involved in helping set that 25' setback on the creek <br /> banks. So 1'm very interested and concerned that first opportunity to apply that <br /> ordinance and we haven't really had an opportunity to test it, so this is kind of <br /> our first test. When we looked at that ordinance, we did get recommendations <br /> to look at 15' setback, 25' setback, even 50' setback, and so we spent a lot of <br /> time looking at that, got many opinions, and we felt that the 25 foot was the <br /> right answer. We thought so, and so did the City Council. And so, that was <br /> done to protect the environment and to support development in our City, which <br /> are both very important. So 1'm very concerned that now the first time we have <br /> an opportunity to do that we are making a potential decision to override that <br /> and accept a 15' setback — So 1'm pretty concerned about that.
