Other Consultants. The City reserves the right to employ other consultants in connection wifih the Services. 1�. lndemnification. Consultant wiil defend, indemnify and hold harmless City and its officers, agents, employees and volun�eers from and against a1! claims, damages, losses and expenses inciuding attorney fees arising out of the performance of fihe Services, caused in whoie or in part by the w�llful misconduct or any negligent act or omission o�the Consultant, any subcontractor, anyQne directly or indirectly emp[oyed �y any of them or anyone for whose acts any of thern may be liab(e, except where caused by the active negligence, sole negligence, or wil)ful m�sconduct of City. The Parties expressly °agree that any reasonable payment, attorney's�fee, cost or expense City incurs or makes to or on behalf of an injured employee under the Gi#y's self-administered workers' compensation ;s ;;-;cl�ded �s a loss, expense or cost for the purposes of this section, and that this section wil! survive the expiration or early termination of the Agreement. 11. Insurance. Consultant will obtain and maintain for the duration of fhe Agreement and any and all amendments, insurance against claims for injuries to persons or �amage to property wh�ch may arise out of or in connection vuith performance of the Services by Consultant or Gonsuitant's agents, representatives, employees or subcontractors. The insurance wili be obtained firom an insurance carrier admitted and authorized to do business in the State of California. The insurance carrier is required to have a current Best's Key Rating of not �ess than "A-:V." 1'�.1 Co�erages and Limits. Consultant will maintain the types of co�erages and minimum lim�ts indicated below, unless Risk Manager or City Manager, in consultation with the City Attorney appro�es a lower amount. These minimum amounts of coverage wi�l not cons�itute any limitations or cap on Consulfan�'s indemnification obligations under this Agreemenfi. City, its officers, agents, volunte�rs and employees make no representation that the limits of the insurance specified to be carried by Consul�ant pursuant to this Agreement are adeguate tv protect Consultant. !f Consultant belie�es that any required insurance coverage is inadequate, Consultanfi will obtain such additional insurance coverage, as Consulfiant deems adequate, at Consultant's sole expense. '�1.�.1 Comrnercial General Liability lnsurance. $1,000,�0� combined single-limit per occurrence for bodily injury, personal tnjury and property damage. !f the submitted policies contain aggregate limits, general aggregate limits will apply separately to the work under �his Agreement or the genera� agg�ega�e wi11 be twice the req�ired per occurrence iimit.
