<br />Project for the purposes of this Agreement, including, but not <br />limited to, the inspection of the work being performed in <br />constructing the proj ect. Such officers, employees, agents or <br />representatives of the Agency and/or the City shall be those <br />persons who are so identified by the Executive Director of the <br />Agency, or his or her designee. <br /> <br />w. Participant shall provide the Agency and/or the City <br />with a completion bond or completion guaranty, issued by an insurer <br />approved by the Agency and/or the City in the reasonable exercise <br />of its discretion, which shall insure that the Project will be <br />completed if Participant defaults in the terms of this Agreement <br />regarding completion of the Project in compliance with the Schedule <br />of Performance. The completion bond will be in an amount not less <br />than the amount estimated by Participant for the complete <br />construction of the proj ect as set forth in pro forma budgets <br />prepared by Participant and approved by the Agency and/or the City. <br /> <br />x. Participant acknowledges that federal funds will be <br />used in the development of the proj ect. Participant agrees to <br />provide the Agency and/or the City with such forms and/or reports <br />as might be required by the terms of the federal program from which <br />such funds are derived. If Participant enters into any leases with <br />any tenants on the Property, the leases shall contain language <br />requiring the tenants to provide the Agency and/or the City with <br />such forms and/or reports as might be required by the terms of the <br />federal programs. <br /> <br />y. With regard to Federal Laws and <br />Participant shall, unless otherwise exempted under <br />or local law, comply with following as set forth <br />(Sec. 570.600-612), Code of Federal Regulations <br />1988) : <br /> <br />regulations, <br />Federal, State <br />in Subpart K, <br />(September 6, <br /> <br />1. Public Law 88-352, Title VI of the Civil Rights <br />Act of 1964, which provides that no person in the United States <br />shall be excluded from participation in, be denied the benefits of, <br />or be subjected to discrimination under any program or activity <br />receiving Federal financial assistance, including community <br />development funds, on the grounds of race, color, national origin, <br />religion or sex. <br /> <br />ii. Public Law 90-284, Fair Housing Act (42 U.S.C. <br />3601- 20), which provides that it is the policy of the United <br />States to provide, within constitutional limitations, fair housing <br />throughout the United States and prohibits any person from <br />discriminating in the sale, rental, or financing of housing on the <br />basis of race, color, religion, sex, national origin, disabilities <br />or familial status. <br /> <br />12 <br />
