<br />building requirements are applicable to the use and development of <br />the Property pursuant to this Agreement. Participant acknowledges <br />that any change in the plans for development or the use of the <br />Property as set forth in the Scope of Development shall be subject <br />to (i) the prior written approval of the Agency and (ii) the City's <br />zoning ordinances and building requirements. <br /> <br />c. The Scope of Development is approved by the Agency <br />upon its execution of this Agreement. The Proj ect shall be <br />developed and completed in conformance with the approved Scope of <br />Development and any and all other plans, specifications and similar <br />development documents required by this Agreement, except for such <br />changes as may be mutually agreed upon in writing by and between <br />Participant and the Agency. <br /> <br />d. The approval of the Scope of Development by the <br />Agency hereunder shall not be binding upon the City Councilor the <br />Planning Commission of the City with respect to any approvals of <br />the Project required by such other bodies. If any revisions of the <br />Scope of Development as approved by the Agency shall be required by <br />another government official, agency, department or bureau having <br />jurisdiction over the development of the Property, Participant and <br />the Agency shall cooperate in efforts to obtain waivers of such <br />revisions, or to obtain approvals of any such revisions which have <br />been made by Participant and have thereafter been approved by the <br />Agency. The Agency shall not unreasonably withhold approval of <br />such revisions. <br /> <br />e. Notwithstanding any provision to the contrary in <br />this Agreement, Participant agrees to accept and comply fully with <br />any and all reasonable conditions of approval applicable to all <br />permits and other governmental actions affecting the Project. <br /> <br />f. Participant shall cause landscaping plans for the <br />Project to be prepared by a licensed landscape architect acceptable <br />to Participant and the Agency. Participant shall prepare and <br />submit to the Agency for its approval, preliminary and final <br />landscaping plans for the Property. These plans shall be prepared, <br />submitted and approved within the times respectively established <br />therefor in the Schedule of Performance and shall be consistent <br />wi th the Scope of Development. Participant shall prepare and <br />submit development plans, construction drawings and related <br />documents for the development of the Project consistent with the <br />Scope of Development to the Ci ty and the Agency for review <br />(including, but not limited to, architectural review of the <br />exterior of structures); provided, however, that the Agency shall <br />not have the right to approve development plans, construction <br />drawings or related documents for purposes of the issuance of a <br />building permit or otherwise on behalf of the City. Additionally, <br />for purposes of this Agreement, the Parties acknowledge that the <br />Agency's approval of said plans, drawings and development documents <br /> <br />7 <br />
