<br />RES 0 L UTI 0 N <br /> <br />N o. 352 <br /> <br />AUTHORIZING CONDEMNATION OF AN EASEMENT <br />ALONGSIDE PRESENT F,ASEMENT ON PULGAS <br />LINE FOR INTERCEPTOR SEWER <br /> <br />RESOLVED by the City Council of the City of Redwood <br /> <br />City that it finds, determines and hereby declares: <br />That public interest and necessity require the qcqulsi- <br />tion, construction a~Q. 'completion by the C1 ty of Redwood C1 ty of <br />a public improvement, ~:1lamely: an interceptor sewer in connection <br /> <br />with the sewagetveatment and dlsposa~ plant of said City in th@t <br />certain property hereinafter in this Resolution described; <br /> <br />That the use of all of said lands for said interceptor <br /> <br />.;~. <br /> <br />sewer is a public use authorized by law; <br /> <br />That the acquisition of an easement in said property 1s <br />necessary to and for such public use and that it is necessary that <br /> <br />an easement in all of said property he so acquired; <br />That said interceptor sewer is planned and located in a <br />manner which will be most compatible with the greatest public good <br /> <br />and the least private injury; <br />FURTHER RESOLVED that the City Manager of this City be <br /> <br />@nd he is hereby authorized and empowered <br /> <br />To acquire an easement in the name of this City in the <br /> <br /> <br />real property hereinafter described for the construction and main- <br /> <br /> <br />tenance of said interceptor sewer in accordance with the Code of <br /> <br />Civil Procedure of the State of California relating to eminent <br /> <br />domain; <br /> <br />To prepare and prosecute, in the name of this City, such <br />suit in the proper Court having Jurisdiction therein as is necessary <br /> <br />to condemn an easement in such land for such use; <br /> <br />To make application to said Court for an order fixing <br /> <br /> <br />the amount of such security in the way of money deposits as said <br /> <br />Court may direct to be made upon the taking of possession of said <br /> <br />I.' <br />
