<br />RES 0 L UTI 0 N <br /> <br />N o. <br /> <br />361 <br /> <br />AUTHORIZING CONDE1mATION OF LAND IN FEE FOR <br />PUBLIC STREET <br /> <br />RESOLVED by the City Council of the City of Redwood City <br /> <br />that it finds and determines and hereby declares: <br /> <br />That public interest and necessity require the acquisi- <br />tion, construction and completion by the City of Redwood City of <br /> <br />a public improvement, namely, a public street and the diversion <br /> <br />of the easterly branch of Redwood Creek and the construction of a <br />culvert in those certain lends hereinafter in this resolution <br /> <br />described; <br /> <br />That the use of all of said lands for said public street <br /> <br />is a public use authorized by law; <br />That the taking of said lands in fee is necessary to and <br /> <br />for such public use, and that it is necessary that all of said lands <br /> <br />be so taken; <br /> <br />That said proposed public street is planned and located <br /> <br />in e. manner which will be most compatible with the greatest public <br /> <br /> <br />good and the least private injury. <br /> <br /> <br />FURTHER RESOLVED that the City Manager of this City be <br /> <br />and he is hereby authorized and empowered: <br /> <br />To acquire, in fee, in the name of this City, the said <br />hereinafter described lands by condemnation in accordance with the <br />provisions of the Code of Civil Procedure of the State of California <br /> <br />relating to eminent domain; to prepare and prosecute in the name <br /> <br />of this Ci t-y- such sui t or sui ts in the proper court ha ving juris- <br /> <br />diction therein as are necessary to condemn said lands in fee for <br /> <br />said use; <br /> <br />. <br /> <br />To make an application to said cour~ for an order fixing <br />the amount or amounts of such security in the way of money de- <br />posits as said court may direct to be made upon the taking of <br /> <br />1. <br />
