<br />WHEREAS, said Council of said City of Redwood City has <br />now acquired jurisdiction to finally ~prove and confirm the engin- <br />eer's report as amended; and <br />WHEREAS, said City Council thereupon duly considered said <br />report as amended and each and every part the'reof, and found that it <br />contained all the matters and things called for by the provisions <br />of Section 2 of the ttMunicipal Improvemen t A.ct of 1913", Inc1 tiding <br />(1) plans and specifications of the proposed improvement, (2) esti- <br />luate of costs, (3) diagram of district, and (4) a new assessment <br />according to benefits, all of which was done in the form and manner <br />required by said Act; and <br />WHEREAS, said Council found that said report and each and <br />every part thereof was sufficient in every particular and determined <br />that it should stand as the report for all subsequent proceedings <br />under said Act; <br />NOW, THEREFORE, Said Council does hereby FIND, DETERMINE <br />and ORDER, as follows: <br />1. That the ovmers or one-half of the area to be assessed <br />for the cost of the project did not, at or prior to the time fixed <br />for said hearing, file written protests against the said proposed <br />improvemen ts as a whole, or a.gainst the district or the extent <br />thereof to be assessed for the costs and expenses of said improve- <br />ments as a whole, or as to the Engineer's estimate of said costs <br />and expenses, or against the grades at which said work is provided <br />to be done, or against the diagram or assessment to pay for the <br />costs and expenses thereof. <br />2. That the district benefited by said improvements and <br />to be assessed to pay the costs and expenses thereof, and the ex- <br />terior boundaries thereof, is more particularly described in Reso- <br />lution of Intention No. 1946-1, and made a part hereof by reference <br />thereto. That all public streets and highways within said assess- <br />ment district, the same being in use in the performance of a public <br />function as such, shall beormitted from said district and from the <br /> <br />2 <br />
