<br />7A <br />Page 17 <br /> <br />ATTACHMENT 1 <br /> <br />In response to letters and articles questioning the RFP process, the SBWMA Executive Director <br />solicited letters. attesting to the transparency and integrity of the RFP process from proposers <br />actively competing for an SBWMA contract. The email request, dated August 23,2008, is quote <br />below: ' <br /> <br />"Subject: Special request <br /> <br />Hello. 1m sure you all saw the articles friday in three different papers re: Allied'g <br />desperate plea for consideration of their alte~tive proposal. Allied's intentions are quite <br />clear: they want the results ofhoth procurements thrown out and for cities to negotiate a <br />package deal to keep them as the hauler and shoreway opearator. <br /> <br />Given the above, i have.a special and awkward request to make: can....write a letter <br />stating that, while yo.u are certainly disappointed wth the results and you not being <br />selected, you feel ,the rfp processes were conducted professionally, thoroughly, and with. <br />the highest level of transparency and integrity. C~ you write this letter? If so, can you <br />. email a signed copy to nle by monday morning? My intent would be to attach this to my <br />response. 1m making a similar request of [other proposers 1 <br /> <br />If one of you can call me on my cell this weekend to confirm if you can meet this special <br />request. My cell no is........ Thanks for the consideration I" . <br /> <br />With this email, the copy of a newspaper article about Allied (see Attachment 2) was also sent to <br />the proposers. The newspaper article contained controversial infonnation about Allied, as <br />admitted to by staff in a SBWMA meeting on August 28, 2008. Allied's lawyer attempted to <br />elicit an apology from the executive at a SBWMA Board meeting, but the apology was denied on <br />the grounds that it was not legally necessary. (see Attachment 3). <br /> <br />One proposer refused to comply with the Executive Director's request to validate the fairness of <br />the RFP process. Instead, he sent a copy of the Executive Director's email to a'member of the <br />sari Mateo County Board of Supervisors, who in turn publicized it to the press and to the elected <br />officials of the member agencies. The Executive Director learned of this, and on August 28, in <br />the San Mateo Library, during a SBWMA Board meeting br~ confronted said proposer with <br />vulgar 1 anguage. <br /> <br />As a result of the events, the following actions were taken by the SBWMA Board of Directors to <br />curtail the Executive Director's power as quoted in a letter from the Chairman of the SBWMA <br />Board to a San Mateo County Supervisor dated September 4,2008. An excerpt of the letter <br />follows: <br /> <br />1. "The Executive Director will no longer participate as a member of the Facility Operations <br />Contractor Selection Committee; . <br />2. The ~xecutive Committee (Chair or Vice Chair of SBwMA Board) will review and <br />approve direct correspondence with proposers or the member agencies regarding the <br />selection process; <br /> <br />13 <br />
