This I.esponse was approved by the Board at a public meeting held on July 23,2009. <br />We have responded directly to the Recommendations of the Civil Grand Jury in this letter, and <br />address the Findings and Conclusions in the attached Addendum 1, and the facts/comments in the <br />Background Section in Addendunl 2. <br /> <br />I - Initial Comments <br />The SBWMAts goal fot d'le RFP process was to select the best cqtnparucs through a. detailed and <br />open evaluation process of the responses that could provide the desired setvice.s in the most cost- <br />effective and environmentally superior manner . We believe that goal was accomplished. In <br />selecting N01"cal (now 1m own as Rccology) and South Bay Recycling (SBR) for consideration by the <br />:Member Agencies as the future se.rvice providets, the SBWMA did exacdy as it had promised it <br />would do through the Rfl1} process - select the highest-rated, best firm for e.ach selvice. <br /> <br />TIle SBWMA went dltough a. very thorough and intensive process in developing, issuing and <br />evaluating the RFPs for both th.e collection services and facility ope~tions services. lnc RFPs <br />clea.rly prescribed the proposal req'Uirements, evaluation process and scoring system. This process <br />took place over a four-year period to ensure that the SBWl\fA Member Agencies' staff and elected <br />officials, potential proposers) odler stakeholders and the public had multiple opportunities for <br />review and input. SB\'{l:tviA Board of Directors, potencial proposers) consultants, legal counsel and <br />other stakeholders helped. develop and write the RFPs) selection ai.te.1'ia and the scoring system <br />before the RFPs were issued. There were no objections to the RFPs received from the proposers <br />until the recommendations for the selected cornpanies were announced. The City of San 'J\.1ateo <br />.retained an indepen.dent consultant to review the Collection SC1"\rices RFP evaluations of the <br />proposals to ensu.re they were done appropria.tely.
