No elected officials are on SB JJ7.MA ~ Board of Directors. <br />Response: (Respondent agrees partially with this Finding.) <br />This statement is correct and reflects the desire of a 2/3 majority of the SBWMA's !\1ember <br />Agencies. Any decision to amend the JP A regarding the constitution of Board members is not a <br />decision for the Board, but for the elected officials of the 1-fember Agencies pursuant to Sec. <br />17.1 of the JP A agreement. There has never been a positive response from the Member <br />Agencies to change the Board composition. In 2005, several of the powers of the Board were <br />moved to the JVfember Agencies (such as approving any Franchise agreement for Operation of <br />the Transfer Station, or for SBWMA bonding and financing decisions). <br /> <br />The JP A was also amended in 2005 to provide for specific City :tvfanager or other entity staff <br />members to be designated for the Board to both provide for specific qualified staff members <br />and also to have a consistent group of staff nlembers attending as Board members. The <br />Member Agencies had to vote on the Amended JP A Agreement, and did so in 2005, approving <br />it by a 2/3 vote. In doing so) the ~fember Agency governing bodies (e.g., city councils) rejected <br />the notion of elected officials being on the Board as a minority of the JP A Members had <br />requested. <br /> <br />Subsequently the issue has been raised by the Board of Supervisors to the Member Agencies and <br />by one of the other JP A Members, and received no support. From the standpoint of the <br />SBWMA Board, it is not its decision but one for the governing bodies of the 11elnbers of the <br />JP A and it will of necessity go along with what those bodies decide under the tenus of the JP A <br />to do. <br /> <br />SB~1A Grand Jury Response_Addendum l.doc <br /> <br />Page 60f9 <br />
