, . 1. IMPROVEMENTS. Owner shall, at Owner's own cost and expense, construct all of the improvements ("Improvements'), furnish all the materials, and do all the work hereinafter described, in accordance with, and as provided for in the plans prepared for Owner by BFK Engineers, Inc., Consulting entitled, "The Preserve at Redwood Shores", and in accordance with City's Specifications entitled, "Engineering Standards for the City of Redwood City", adopted December 4, 2006, which plans and specifications are on file in the office of the Manager, Engineering and Construction. Said Improvements shall also be constructed in strict compliance with the provisions of Chapter 30 of the Code of the City of Redwood City, the subdivision regulations of City. To the extent that a conflict exists between the plans and specifications and said Chapter 30 in regard to the standard for a particular improvement, the stricter standard shall govern. Owner shall complete all of the ImprQvements, subject to time extensions allowable under Paragraph 11 of this Agreement, on or before December 31, 2011. The Improvements shall include, but are not necessarily limited to, all of the following: (a) grading, paving (b) curbs, gutters, driveways (c) water system, complete (d) storm drainage system, complete (e) street trees, street monuments (f) landscaping and recycled water irrigation system, complete (9) utility joint trenching (h) stormwater treatment planting and mechanical systems (i) all conditions of approval for Tentative Subdivision Map T.M. No. 2008-02 and P.C. 2008-02, heretofore issued for said subdivision, and all other work,improvements, or construction required by or mentioned in the abovementioned plans and specifications, conditions of permits and all construction, appurtenances and improvements necessary as reasonable determined by the ATTY/AGR/2009.032 071309 2
