02/22/2021 <br />RESOLUTION NO. 15935 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY VACATING A PUBLIC SERVICE EASEMENT LOCATED AT 3558 <br />JEFFERSON AVENUE IN THE CITY OF REDWOOD CITY PURSUANT <br />TO PART 3 OF DIVISION 9 OF CHAPTER 4 OF THE CALIFORNIA <br />STREETS AND HIGHWAYS CODE <br />WHEREAS, pursuant to the provisions of Part 3 (commencing at Section 8300) of <br />Division 9 of Chapter 4 of the California Streets and Highways Code, the City Council of <br />the City of Redwood City ("City Council'), is authorized to vacate the public service <br />easement located 3558 Jefferson Avenue, located as shown on the Subdivision Map <br />"Highlands of Emerald Lake Subdivision One" in Book 13 of Maps, at Pages 24 through <br />27, in the office of the Recorder for the County of San Mateo; and <br />WHEREAS, that public service easement to be vacated is described in Exhibit A <br />and Exhibit B ("Vacation Area"), attached hereto and incorporated by reference; and <br />WHEREAS, because there are no in-place utilities that are in use, vacation of the <br />Vacation Area is not subject to any reservations or exceptions; and <br />WHEREAS, the Vacation Area has not been used for the purpose for which it was <br />dedicated or acquired for five consecutive years immediately preceding the proposed <br />vacation; and <br />WHEREAS, the Vacation Area has been determined to be excess by the City, and <br />there are no other public facilities located within the easement. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />REDWOOD CITY AS FOLLOWS: <br />1. The recitals set forth above are true and correct, and are hereby <br />incorporated herein by this reference as if fully set forth in their entirety. <br />2. Pursuant to Section 8333 of the Streets and Highways Code, the Vacation <br />Area is not used for public purposes. <br />3. Public money was not expended for maintenance within the Vacation Area. <br />4. The right of way located in the Vacation Area depicted and described in <br />Exhibit A and Exhibit B is hereby ordered vacated. <br />5.
