The City Council of the City of Redwood City hereby adopts the Zoning
Ordinance Amendments as provided in Exhibit "A", attached hereto and incorporated by
reference, by adding the text shown in underline (example) and deleting the text shown in
strikeout (fie). Wording in brackets ([example]) is informational only and is not to be
included in the published ordinance.
Section 4. The proposed Zoning Ordinance Amendments have been reviewed with
respect to applicability of the California Environmental Quality Act ("CEQA") and the State
CEQA Guidelines (California Code of Regulations, Title 14, Sections 15000 et seq.).
Adoption of an ordinance regarding accessory dwelling units in a single-family or multifamily
residential zone to implement the provisions of Government Code is an action that is
exempt from the provisions of CEQA under Public Resources Code Section 21080.17 and
CEQA Guidelines Section 15282(h). The remaining amendments have been evaluated and
found to not have an impact on the environment under CEQA Guidelines Section
15061(b)(3) as it can be seen with certainty that they will not have an impact on the
environment, as described in the staff report.
Section 5. The City Council hereby declares every section, paragraph, sentence,
cause and phrase is severable. If any section, paragraph, sentence, clause or phrase of this
ordinance is for any reason found to be invalid or unconstitutional, such invalidity, or
unconstitutionality shall not affect the validity or constitutionality of the remaining sections,
paragraphs, sentences, clauses or phrases.
Section 6. Applicability. The Zoning Ordinance Amendments shall not apply to
building permit applications that are submitted prior to the Zoning Ordinance Amendments'
effective date. Accessory dwelling units shall be used in accordance with the provisions of
the Zoning Ordinance Amendments upon their effective date.
Section 7. The City Clerk is directed to cause this ordinance to be published in the
manner required by law.
Section 8. This ordinance shall go into effect 30 days following its adoption.
ATTY/ORD.529/ACCESSORY DWELLING UNIT REQUIREMENTS
REV: 02-26-2021 PR
73
