<br />Construction and Demolition Debris <br /> <br />"Construction and Demolition Debris" means materials resulting from construction, renovation, <br />remodeling, repair, or demolition operations on any residential, commercial or other structure or <br />pavement. Also called "C&D." <br /> <br />Contamination <br />"Contamination" means materials that are delivered to the MRF and that accompany Acceptable <br />Materials but which are not an Acceptable Material. <br /> <br />Contractor <br />"Contractor" means South Bay Recycling, LLC, a California limited liability company. <br /> <br />Contractor's Compensation <br /> <br />"Contractor's Compensation" means the monetary compensation to be received by Contractor <br />in return for providing services in accordance with this Agreement, as described in Article 7. <br /> <br />Contractor's Proposal <br /> <br />"Contractor's Proposal" means the proposal submitted by Contractor and received on March 4, <br />2008 by the Authority in response to the November 1, 2007 Request for Proposals, and certain <br />supplemental written materials (written responses to addenda and written correspondence <br />submitted during the short list negotiation phase between July 25, 2008 and April 22, 2009). <br /> <br />County <br />"County" means the County of San Mateo. <br /> <br />Day <br />"Day" means calendar day unless otherwise specified. <br /> <br />Designated Disposal Site <br /> <br />"Designated Disposal Site" means the facility or facilities utilized for the landfill Disposal of Solid <br />Waste, which shall be the Ox Mountain Sanitary Landfill near Half Moon Bay, unless and until <br />the Authority designates a different or additional site. <br /> <br />Designated Processing Facility{ies) <br /> <br />"Designated Processing Facility" means one of the off-site facilities designated by the Authority <br />as the location(s) for processing of Construction and Demolition Debris, Plant Materials, <br />Organics and other fractions of the waste stream delivered to the Shoreway Center not <br />delivered to the Designated Disposal Site. <br /> <br />Disposal <br />"Disposal" means the ultimate disposition of Solid Waste by Contractor at the Designated <br />Disposal Site. <br /> <br />Disposal Agreement <br /> <br />"Disposal Agreement" means the agreement dated as of January 1, 2005 between the Authority <br />and the operator of the Ox Mountain Sanitary Landfill. <br /> <br />SBWMA Facility Operations Agreement, Attachment 1 <br />Definitions <br /> <br />Page 3 of 10 <br />1967648.2 <br />
