<br />Household Batteries <br /> <br />"Household Batteries" means disposable or rechargeable dry cells (e.g., A, AA, AAA, B, C, D, 9- <br />volt, button-type) commonly used as power sources for household or consumer products <br />including, but not limited to, nickel-cadmium.. nickel metal hydride, alkaline, mercury, mercuric <br />oxide, silver oxide, zinc oxide, nickel-zinc, nickel iron, lithium, lithium ion, magnesium, <br />manganese, and carbon-zinc batteries, but excluding automotive lead acid batteries. <br /> <br />Implementation and Operation Plan <br /> <br />"Implementation and Operation Plan" means Contractor's plan set forth in Attachment 4. <br /> <br />Including <br />"Including" means including but not limited to. <br /> <br />Infectious Waste <br /> <br />"Infectious Waste" means biomedical waste generated at hospitals, public or private medical <br />clinics, dental offices, research laboratories, pharmaceutical industries, blood banks, mortuaries, <br />veterinary facilities, and other similar establishments that are identified in State Health and <br />Safety Code Section 25117.5. <br /> <br />Liquidated Damages <br /> <br />"Liquidated Damages" means the amounts owed by Contractor to the Agency for failure to meet <br />specific standards of performance as described in Section11.07. <br /> <br />Materials Marketing Plan <br />"Materials Marketing Plan" means Contractor's plan included in Attachment 11. <br /> <br />Materials Recovery Facility (MRF) <br /> <br />"Materials Recovery F acility" and "MRF" each mean the building at the Shoreway Center where <br />Recyclable Materials are processed, sorted or separated for the purposes of recovering <br />reusable or Recyclable Materials. <br /> <br />Member Agencies <br /> <br />"Member Agencies" means the following jurisdictions: the cities of Belmont, Burlingame, East <br />Palo Alto, Foster City, Menlo Park, Redwood City, San Carlos, and San Mateo; the towns of <br />Atherton and Hillsborough; the County of San Mateo; and the West Bay Sanitary District. <br /> <br />Members <br /> <br />"Members" means the two corporations which own and control the Contractor as of the date of <br />this Agreement. The Members are Community Recycling and Resource Recovery, Inc. and <br />Potential Industries, Inc. <br /> <br />Minimum Self-Haul Diversion Guarantee <br /> <br />"Minimum Self-Haul Diversion Guarantee" means the amount of Self-haul materials that are to <br />be Diverted from total inbound Self-haul tons, as provided in Section 7.08. <br /> <br />SBWMA Facility Operations Agreement, Attachment 1 <br />Definitions <br /> <br />Page 6 of 10 <br />1967648.2 <br />
