ORIGINAL AMENDMENT NO. 1 TO EXTEND AGREEMENT FOR 2010 -2011 Cost Shared Sidewalk Repair Project SpenCon Construction, Inc. Th's Amendment No. 1 is entered into and effective as of the 1 day of yJjAJ/ , 2010, extending the agreement dated August 1, 2009 (the "Agreem nt ") by and between the City of Redwood City, a charter city and municipal corporation of the State of California ( "City "), and SpenCon Construction, inc., ( "Contractor ") (collectively, the "Parties ") for performing sidewalk repair services. RECITALS A. On August 1, 2009, the Parties executed an Agreement for Cost Shared Sidewalk Repair Project; and B. The Parties desire to extend the Agreement for a period of one year through August 1, 2011. NOW, THEREFORE, in consideration of these recitals and the mutual covenants contained herein, the Parties agree as follows: 1. Contractor will provide those services described in the Agreement. With this Amendment, the total aggregate Agreement amount shall not exceed Four Hundred Thousand Three Hundred Eighty Four and 63/100 dollars ($470,384.63). 2. City will pay Contractor for all work associated with those services described in the Agreement on a unit bid price basis not -to- exceed Two Hundred Forty Four Thousand Two Hundred and Thirty dollars ($244,230.00). Contractor will provide City, on a monthly basis, copies of invoices sufficiently detailed to include work performed, unit bid rates, and related activities and costs for approval by City. 3. Contractor will perform tasks described in the Agreement through August 1, 2011. 4. All other provisions of the Agreement, as may have been amended from time to time, will remain in full force and effect. 5. All requisite insurance policies to be maintained by the Contractor pursuant to the Agreement, as may have been amended from time to time, will include coverage for this Amendment. /// /// /// ATTY /AGR/2010 /AMENDNO.1 1 092310
