<br />6.38 <br />Page 3 <br /> <br />RESOLUTION NO. <br /> <br />RESOLUTION OF THE CITY COUNCil OF THE CITY OF REDWOOD <br />CITY APPROVING AN IDENTITY THEFT PREVENTION PROGRAM <br />PURSUANT TO FEDERAL RED FLAG RULES <br /> <br />WHEREAS, the Fair and Accurate Credit Transactions Act of 2003 empowered <br />the Federal Trade Commission (FTC) to enact regulations requiring banks and creditors <br />to establish anti-identity theft programs, referred to as URed Flag Rule"; and <br />WHEREAS, as part of the requirements imposed by the FTC, municipal utilities <br />are considered creditors, and <br />WHEREAS, the City of Redwood City is identified as a municipal utility by the <br />Federal Trade Commission (FTC); and <br />WHEREAS, as a creditor under the FTC's Red Flag Rule, the City is required to <br />establish an Identity Theft Prevention Program by November 1, 2009; and <br />WHEREAS, the FTC requires that the City Council approve a written policy and <br />procedures for identifying red flags associated with identity theft; and <br />WHEREAS, the Identity Theft Prevention Program - Red Flag Rule policy of the <br />Revenue Services Division of the Finance Department of the City of Redwood City <br />meets the requirements set forth by the FTC. <br />NOW, THEREFORE BE IT RESOLVED BY THE COUNCil OF THE CITY OF <br />REDWOOD CITY, AS FOllOWS: <br />The Identity Theft Prevention Program - Red Flag Rules is approved and is <br />attached hereto as Exhibit &CAli. <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />ATTY/RESO/RESO.1943 <br />090109 <br />
