<br />7A <br />Page 2 <br />condition of receiving the rebate funds, the San Mateo County Energy Watch Energy <br />Efficiency Program Customer Work Order Agreement (UCustomer Work Order <br />Agreement") requires the city to enter into an agreement with ASI for the total installed <br />project cost of $94,879.84. Pursuant to the Customer Work Order Agreement, 8M <br />Energy Watch will make the rebate payment directly to ABI. Payment of the rebate will <br />lower the cttys actual costs for this project to $54,568.42. The city is expected to fully <br />recover its cost to upgrade the Jefferson Avenue Garage within 1.1 years. In light of the <br />foregoing, the anticipated cost to the city for the purchase and installation of these <br />conservation measures will be less than the anticipated marginal cost to the city of the <br />electrical energy that would have been consumed by the city without the purchase and <br />installation of these conservation measures. It should also be noted that the unit prices <br />made available to the city through its participation in SM Energy Watch have been <br />markedly discounted. <br /> <br />Government Code Sections 4217.11 through 4217.17 provide that notwithstanding any <br />other provisions of law, a public agency may enter into an energy service contract on <br />terms that its governing body determines are in the best interests of the public agency. <br />SM Energy Watch has already prescreened and selected ABI as one of its preapproved <br />participating contractors. Furthermore, ABI successfully provided similar services to the <br />city through the ABAG Energy Watch Program. The city finds that based on ABl's past <br />performance, that it would be in the best interests of the public agency to continue to <br />work with this proven participating contractor. The decision must be made at a regularly <br />scheduled public hearing, public notice of which is given at least two weeks in advance. <br /> <br />AL TERN A TIVES <br />Council may choose not to approve the agreement and direct staff to modify the work or <br />terms of this project. <br /> <br />FISCAL IMPACT <br />The total contract cost for the work is $94,879.84. Of this amount, $54,568.42 is <br />payable by the city. The balance, $40,311.42, is provided by PG&E as a rebate <br />payable directly to the contractor. Funds for this contract have been appropriated in <br />the current budget as Capital Projects Fund - Civic Facilities ReJamping Program which <br />has an available balance of $76,369.06 as of July 31, 2009. <br /> <br />~ <br />~ Lee.
