6.18 Page 1 REPORT To the Honorable Mayor and City Council From the Cit Mana er September 14,2009 SUBJECT Amendment No. 4 to the 2005-2006 Comprehensive Street Tree Maintenance Agreement with The Professional Tree Care Company, Inc. RECOMMENDATION By motion approve Amendment No. 4 to the 2005-2006 Comprehensive Street Tree Maintenance Agreement with The Professional Tree Care Company, Inc. in the amount of $230,333, and authorize the City Manager to increase the contract amount, if necessary, up to 100/0 of the amount awarded. BACKGROUND On October 25, 2005, the contract was awarded to The Professional Tree Care Company, Inc. of Berkeley, CA in the amount of $218,595, for the 2005-2006 Comprehensive Street Tree Maintenance Program. Language in the Agreement allowed for up to four consecutive one-year extensions. On February 1, 2007, Amendment No.1 was issued to extend the Agreement through August 31, 2007, in the amount of $218,595. On June 6, 2007, Amendment Number 2 was issued to extend the Agreement through August 31, 2008 in the amount of $224,060. On July 21, 2008 Amendment Number 3 was issued to extend the Agreement through August 31,2009 in the amount of $230,333. With this Amendment the total aggregate Agreement amount shall not exceed $1,121,916. The contractor has performed their work to accepted industry standards and staff is confident they will continue to perform work in compliance with accepted industry standards. ALTERNATIVES Do not permit the Amendment to the Agreement and direct staff to re-bid the entire project. FISCAL IMPACT Funds are available in the amount of $230,333 in the FY 2009-2010 Public Works Services Street Tree Maintenance Budget.
