<br />6.1G <br />Page 3 <br /> <br />MEMORANDUM OF UNDERSTANDING BE1WEEN THE CITY OF SAN CARLOS AND THE <br />CITY OF REDWOOD CITY FOR IMPROVEMENTS OF THE SAN CARLOS LEVEE <br /> <br />THIS MEMORANDUM OF UNDERSTANDING ("MOU") is made and entered Into this <br />day of , 2009, by and between the CITY OF SAN CARLOS, a <br />chartered municipal corporation of the State of California (San Carlos), and the CITY OF <br />REDWOOD CITY, a chartered municipal corporation of the State of California {"Redwood City"):" <br />collectively, the "Parties"; <br /> <br />REelT ALS <br /> <br />WHEREAS, the Federal Emergency Management Agency (FEMAII) is implementing a <br />Flood Map Modernization ("Map Mocf') program to convert paper Flood Insurance Rate Maps <br />("FIRMs") to digital; and <br />WHEREAS, as part of Map Mod, FEMA mandates all levees to be certified to meet the <br />requirements of Title 44 of the Code of Federal Regulations section 65.10 of the National Flood <br />Insurance Program before the Spring of 2010 publication date of the new digital FIRMs; and <br />WHEREAS, Redwood City is undertaking a levee Improvement and certification project <br />(the UProjeef') to raise the height and certify the perimeter levees in the Redwood Shores area to <br />protect the Redwood Shores Peninsula from flooding; and <br />WHEREAS, FEMA has determined that a segment of levee bordering the Steinberger <br />Slough near Highway 101, owned and maintained by San Carlos, must be Improved and certified to <br />complete the flood protection for the Redwood Shores Peninsula; and <br />WHEREAS, it is mutually advantageous to the Parties for Redwood City to undertake the <br />improvements to the San Carlos levee ("San Carlos Levee Project"), and 'to recover the portion of <br />the Project cost attributable to the San Carlos Levee Project through cost reimbursement from <br />San Carlos; and <br />WHEREAS, the general location of the San Carlos Levee Project is depicted on the map <br />attached hereto as Exhibit A and incorporated herein by this reference; and <br />WHEREAS, the San Carlos Levee Project is subject to permitting from the United States <br />Army Corps of Engineers, United States Fish and Wildlife Services California San Francisco Bay <br />Regional Water Quality Control Board, California Department of Fish and Game and the San <br />Francisco Bay Conservation and Development Commission (collectively, -Regulatory Agencies.); <br />and <br /> <br />WHEREAS, San Carlos is willing to reimburse Redwood City for construction of the San <br />Carlos Levee Project; and <br />
