Such headings and titles will not be construed as modifying, limiting or <br />expanding in any manner the terms and provisions of this Agreement. <br />25. Representations and Warranties. <br />(a) Of Cargill Point and Cargill. Cargill Point and Cargill each warrant that it <br />has full right and lawful authority to enter into this Agreement, to grant the Drainage Easement <br />and associated Drainage Access Easement, and to undertake and perform its obligations under <br />this Agreement. <br />(b) Of Grantee Agencies. . Each Grantee Agency warrants that it has full right <br />and lawful authority to enter into this Agreement and to undertake and perform its obligations <br />under this Agreement. <br />26. Notices.
