Grantee is the fee owner of the real property described in Exhibit "A" attached <br />hereto (the "Servient Estate"); <br />B. Grantor, Grantee and Cargill Point, LLC, a Delaware limited liability company, <br />entered into that certain unrecorded Temporary Construction Easement and Agreement dated <br />_, 2021 (the "TCE Agreement"), by which Grantee agreed to grant a "Temporary <br />Construction Easement" as defined in the TCE Agreement over a portion of the Servient Estate <br />defined and described in the TCE Agreement as the "TCE Area" for the limited purposes stated <br />in the TCE Agreement; <br />C. Grantor and Grantee agree to terminate the Temporary Construction Easement <br />over the TCE Area within the Servient Estate created by the TCE Agreement and to terminate <br />the TCE Agreement in its entirety with respect to the Servient Estate; <br />D. Grantor agrees to quitclaim to Grantee all right, title and interest in and to the <br />Temporary Construction Easement and TCE Agreement over any portion of the Servient Estate, <br />including the TCE Area. <br />224 <br />
