7.A. - Page 9 of 53 <br />STAFF RECOMMENDATION <br />A. Number and Location. <br />1. Single Family Dwelling - Number. No more than one (1) accessory dwelling unit <br />and one (1) junior accessory dwelling unit may be located on the same lot that has <br />an existing or proposed single-family dwelling. Duplex and Multiple Dwelling - Number. At least one (1) accessory dwelling <br />unit within an existing duplex or multiple dwelling is permitted and additional <br />accessory dwelling units of up to twenty-five (25) percent of the existing multiple <br />dwelling units. Accessory dwelling units shall be located in conversions of areas that <br />are not used as livable space, including, but not limited to, storage rooms, boiler <br />rooms, passageways, attics, basements, or garages. Not more than two (2) <br />accessory dwelling units detached from that multiple dwelling unit are permitted per <br />lot, and are subject to a height limit of twenty (20) feet and four (4) foot rear yard and <br />side setbacks. Detached second story accessory dwelling_ units shall be subject to <br />the height and other regulations in Section 37.3(C)(3)(b). <br />3. Density. Accessory dwelling units and junior accessory dwelling units do not <br />count toward the allowed density for the lot upon which the unit is located. <br />Accessory dwelling units and junior accessory dwelling units approved in compliance <br />with this article are a residential use that is consistent with the requirements of the <br />General Plan and zoning ordinance. <br />24. Location. Accessory dwelling units may be attached to, detached from, or <br />located within the living area of thean existing dwelling. Junior accessory dwelling <br />units must be located within the single-family home. <br />B. Lot Coverage <br />maximum -allowable lot Gyerag�the underlying g ening distric-t—Accessory <br />dwelling units shall be exempt from the maximum lot coverage requirements of the <br />underlying zoning_ district. Accessory dwelling units shall be exempt from lot coverage <br />requirements of the underlying zoning district and rear yard coverage limitation in <br />Section 5.5 and Section 36.5(G). For the purposes of this article, attached garages. <br />carports, and covered porches shall count towards lot coverage. <br />C. Building Height and Setbacks. <br />1. Setbacks. A four (4) foot side and rear yard setback is required for accessory <br />dwelling units. Except however, no setback is required for an accessory dwelling <br />unit located within existing living area or an existing accessory structureor an <br />accessory dwelling unit that replaces an existing structure and is located in the same <br />location and to the same dimensions as the structure being replaced.
