6.C. - Page 4 of 147 <br />FISCAL IMPACT <br />No monetary consideration is required to obtain the easement agreements and therefore no new funding <br />is requested. <br />ENVIRONMENTAL REVIEW <br />This activity is not a project under California Environmental Quality Act (CEQA) as defined in CEQA <br />Guidelines, sections 15378 and 15061(b)(3), because it has no potential for resulting in either a direct or <br />reasonably foreseeable indirect physical change in the environment. Informationally, on February 24, <br />2020, FLSRRD certified an Initial Study/Mitigated Negative Declaration (IS/MND) for the project. The <br />IS/MND identified potential adverse effects during construction, which will be reduced to less -than <br />significant levels through the implementation of specific mitigation measures as identified in its Mitigation <br />Monitoring and Reporting Program (MMRP). <br />PUBLIC NOTICE <br />Public Notification was achieved by posting the agenda, with the agenda items being listed, at least 72 <br />hours prior to the meeting <br />ALTERNATIVES <br />The City Council may choose to: <br />1. Not authorize the execution of either or both agreements. <br />2. Direct staff to negotiate modifications to the agreements directly with Cargill and other participating <br />agencies. <br />3. Authorize Redwood City to be a party to the agreements and accept the additional rights and obligations <br />contained therein, except that Redwood City would not be a grantee of the specified easements, similar <br />to the County. <br />If the City Council does not authorize both agreements as presented, Cargill may choose to not grant the <br />temporary construction easement to the District.
