Code §27383 LANDSCAPE MAINTENANCE AGREEMENT One20 Towns at 120 EI Camino Real THIS LANDSQAPE MAINTENANCE AGREEMENT ("Agreement") is made and entered into this ay of A -PR-+ � , 20 ("Effective Date"), by and between One2Oth LLC, a Wyoming Limited Liability Company ("Developer"), ), and the CITY OF REDWOOD CITY, a charter city and California municipal corporation ("City") with reference to the following facts: RECITALS A. Reference is made to that certain real property situated in the City of Redwood City, County of San Mateo, State of California, known as 120 EI Camino Real ("Site") and described on Exhibit "A", attached hereto and incorporated by this reference as if fully set forth herein (the "Property"). The Property is being developed as a residential project. Developer expects to transfer its interest in the Property to One20 Towns Community Association ("HOA"), a California nonprofit mutual benefit corporation, which HOA will be ultimately responsible for the management, operation and governance of the Property. B. In connection with its development of the Property as a residential community, Developer submitted to City Improvement Plans, which include, inter alis, landscaping plans for along the Property frontage ("Pians"), all of which Plans have been approved by City. The Plans provide for installation of certain specialty pavements, sidewalks, street trees with grates and guards, landscaping, pedestrian lighting, and irrigation ("Improvements") within the project frontage along Finger Avenue and El Camino Real, as well as within the public easement area on the site ("Maintenance Area") as the Improvements and Maintenance Area are more specifically shown on Exhibit "B" attached hereto and incorporated by this reference as if fully set forth herein.
