<br />Rules of JAMS (i.e., the version of those rules in effect as of the date shown at the <br />top of the accompanying Engagement Letter), before a single arbitrator, selected <br />from the JAMS in San Francisco or San Jose. The parties shall be entitled to full <br />discovery in accordance with the California Code of Civil Procedure for a period of <br />ninety days after service of the demand for arbitration. The arbitrator shall resolve <br />any discovery disputes. Unless the arbitrator decides otherwise, each party will <br />bear its own attorneys' fees and share equally in the payment of the arbitrator's fees <br />and costs. The arbitrator shall attempt to follow the law and not re-write the <br />agreement of the parties. Judgment on the arbitration award may be entered in any <br />court having jurisdiction thereof. <br /> <br />Choice of Law and Forum <br /> <br />The laws of California shall apply in interpreting or enforcing this agreement. Any <br />proceedings relating to this agreement shall be filed and heard in San Francisco or San <br />Jose, California. <br /> <br />Record Retention and Destruction <br /> <br />At the conclusion of your matter, the Firm will return to you any valuable property you <br />have entrusted to us, and the Firm will dispose of any and all superfluous documents <br />consistent with maintaining their confidentiality. Unless you request otherwise, we will <br />store the balance of the file for two years. After that two-year period, unless you make <br />other arrangements and pick up the file, the Firm reserves the right to dispose of these <br />files in the regular course of business, consistent with maintaining confidentiality. <br /> <br />Questions <br /> <br />The Firm strives to provide high quality, cost effective legal services and to provide you <br />with accurate, understandable invoices.
