City of Redwood City <br />Agreement No. SWRCBOOOOOOOOOOD171265500 <br />Amendment 42 <br />Page 7 of 29 <br />8. No Obligation of the State; State Budget Act Contingency <br />Any obligation of the State Water Board contained herein shall not be an obligation, debt, or liability of the <br />State and any such obligation shall be payable solely out of the monies appropriated by the State <br />Legislature to the State Water Board from the special fund associated with this Agreement. <br />If the Budget Act of the current year and/or any subsequent years covered under this Agreement does not <br />appropriate sufficient funds for the program, this Agreement shall be of no force and effect. This <br />provision shall be construed as a condition precedent to the obligation of the State Water Board to make <br />any payments under this Agreement. In this event, the State shall have no liability to pay any funds <br />whatsoever to the Recipient or to furnish any other considerations under this Agreement, and the <br />Recipient shall not be obligated to perform any provisions of this Agreement.
