2 <br /> <br />WHEREAS, such agreements are authorized and provided for by Section <br />51300, et seq. of the California Government Code and under the Parties <br />respective police powers. <br /> <br /> NOW, THEREFORE, IT IS HEREBY AGREED BY THE PARTIES <br />HERETO AS FOLLOWS: <br /> <br />1. Exhibits and Attachments <br /> <br /> The following exhibits are attached to this Agreement and incorporated into this <br />Agreement by this reference: <br /> <br />Exhibit A— Contract Areas <br />Exhibit B— Proportionate Share of Cost <br />Attachment 1 – Agreement between County of San Mateo and the Peninsula <br />Humane Society and SPCA <br />Attachment 2 - Agreement between County of San Mateo and PetData Inc. <br />Attachment 3 - Memorandum of Agreement Regarding Funding For <br />Construction Of An Animal Care Shelter <br /> <br />2. Definitions <br /> <br /> <br /> 2.1 Administrative Costs: The actual costs, including, but not limited to, <br />salaries, benefits, dispatch, and equipment maintenance, incurred by <br />the County to administer the Animal Control Program and Animal <br />Licensing Program as outlined in this Agreement in an effort to facilitate <br />a coordinated countywide system. <br /> <br /> 2.2 Animal Control Contractor: The contractor selected as set forth in <br />Section 5.2 of this Agreement, which is specifically charged with <br />providing services and enforcing laws relating to h animal care and <br />control, shelter services and animal licensing within the territorial limits <br />of the County and the Cities and pursuant to the terms of this <br />Agreement. <br /> <br /> 2.3 Animal Control Program: The program within the Health System of the <br />County, or County’s designated contract agent, or both, or such other <br />agency as the County of San Mateo Board of Supervisors may <br />designate, which is specifically charged with regulating and enforcing <br />laws dealing with animal control within the territorial limits of the County. <br /> <br /> 2.4 Animal Control Services Agreement or Services Agreement: <br />Agreement in which the Animal Control Contractor agrees to perform on <br />behalf of Parties and the County agrees to compensate, using County <br />and City funds, the Animal Control Contractor for performance of certain
