Code § <br />27383. <br />SUBDIVISION IMPROVEMENT AGREEMENT <br />1548 Maple Street <br />THIS SUBDIVISION IMPROVEMENT AGREEMENT ("Agreement") is made and <br />entered into on this day of`l V& , 2021 ("Effective Date"), by and between <br />1548 Maple LLC, a Delaware limited liability company ("Developer"), and the CITY OF <br />REDWOOD CITY, a charter city and California municipal corporation ("City') (individually, <br />a "Party" and, together, the "Parties") with reference to the following facts: <br />RECITALS <br />A. Developer is the current fee owner of that certain real property consisting of <br />approximately 7.88 acres located within the City of Redwood City, County of San Mateo, <br />State of California, described in Exhibit "A", attached hereto and incorporated herein by <br />reference (the "Property"). <br />B. On May 7, 2018, the City Council of the City of Redwood City adopted, <br />among other approvals, Resolution No. 15662, approving the Tentative Map for the 1548 <br />Maple Street Project ("Project"), prepared by BKF and dated September 26, 2017 <br />("Tentative Map"), subject to certain conditions of approval ("Conditions"). <br />C. The Conditions require either (1) that certain public improvements for the <br />Project be constructed prior to approval of the final map for condominium purposes ("Final <br />Map"), or (2) that Developer enter into an agreement with City providing for the future <br />construction of such public improvements. <br />D. Developer has submitted the Final Map and applied to City for Final Map <br />approval without having completed the required public improvements and, therefore, will <br />enter into an agreement with City providing for the future construction and installation of <br />such public improvements, as required by Government Code section 66462(a)(1). <br />E. Developer has submitted to City plans, specifications and drawings entitled <br />1548 Maple Street On -Site Improvement Plans and 1548 Maple Street Off -Site <br />Improvement Plans, prepared by BKF and dated January 15th, 2021 and December 18th, <br />REV: 01-21-2021 PR <br />ATTYIAGR.2021.010/1548 Maple LLC (Page 1 of 29) <br />
