1. There are no special circumstances which pertain to this lot. The lot is <br /> part of a subdivision which created long and narrow lots. There are <br /> several lots in the vicinity which have in excess of the 10,000 square <br /> foot minimum lot size requirement for a triplex, and which do not meet <br /> the 75 foot minimum lot width requirement. Based on current zoning <br /> standards, the subject parcel is simply too narrow to meet the <br /> requirements for a triplex. <br /> <br /> The parcel is located in an area which has recognized parking and <br /> circulation issues. The granting of this variance and subsequent <br /> approvals on similar parcels would be expected to aggravate the <br /> circulation problems as well as compound the parking shortage in the <br /> area. <br /> <br /> 2. The granting of the variance would constitute a grant of special <br /> privilege in relation to other lots in this neighborhood. Although there <br /> are some lots in the area which exceed the density allowance and are <br /> nonconforming to current zoning standards, they were built in <br /> conformance with the codes in effect at that time. <br /> <br /> There have not been any variances granted in this neighborhood for <br /> similar applications. If this application were approved, property owners <br /> seeking to maximize use of their property would have to be afforded a <br /> similar allowance. Because there are no special circumstances, <br /> approval of this variance would in effect trigger a change in policy <br /> which requires review and consideration by the City Council and <br /> Planning Commission. <br /> <br /> 3. The granting of this variance would be contrary to the intent of the <br /> ordinance. The established lot width requirement of 75 feet provides <br /> for adequate light, air, and circulation between multi-family buildings <br /> and property lines. A wider lot width also accommodates a greater <br /> diversity in design of the structure. The intent of the ordinance is to <br /> apply performance standards consistently within each district unless <br /> there are special circumstances which preclude a property owner from <br /> developing his/her lot.
