Since that date, we have been asked to expand our
Tier I work to describe and analyze the feasibility of DMB' s proposal to rely on a surface
water transfer to supply water to the project. This memorandum provides a scope of
work for this additional task.

Our work on the water transfer issue has involved the following tasks:

· Attend work session with DMB representatives to review proposal.

· Meet with water attorney Eric Robinson and review relevant documents
provided by DMB.

· Independently obtain and review publicly available documents.

· Perform legal research regarding reliability of transferred water.

· Identify agencies with approval authority over transfer.

10f2
