By motion, approve the improvement plans, and authorize the executio t�Of R� <br /> Improvement Agreement for the Bair Island Road improvements w� <br /> Peninsula Park , LLC, and <br /> 2.) By resolution, accept the dedications of Public Utility Easements. <br /> BACKGR4UND <br /> On June 7, 2004 the City Council approved the Precise Plan for the Marina Shores <br /> ViUage Subdivision. The subdivision will be located at the end of East Bayshore <br /> Boulevard and Bair Island Road. The scope of this development is not finalized <br /> pending permitting activities by the resource agencies. As such, a formal Subdivision <br /> Map and Condominium Plan have not been submitted. However, the de�efoper wisBhas <br /> to construct improvements within the city right-of-way, includmg reconstruct�ng <br /> tsland Road which fronts their property, as defined in SectiQn 66419 of the State of <br /> California's Subdivision Map Act. Dedications for public utility easements will also 73 <br /> offered by the developer separate from a Subdivis�on Map as defined in Section 30 <br /> of the City of Redwood Ciiy Municipal Code. The dedications are necessary to pro�he <br /> roadway and pedestrian access as shown in the project's Precise Plan. The work in <br /> right-of-way is being done at this time to make the frontage of the property more <br /> attractive. <br /> A typical subdivision process involves the approval of the Subdivision Map first <br /> accompanied by Improvement Plans for all work associated within the right of-way. <br /> Improvements are guaranteed by Performance and Material bonds. The construct� of <br /> work in the right-of-way can happen concurrent with or after the on stte developmen <br /> the homes. It is the wish of this developer to construct right-of-way improvements prior <br /> to finalizing their SubdivisionlCondominium Map. The developer understandn tMha t <br /> proceeding with this work is done at their sole risk and approval of a Subd�visro p <br /> or associated parcels are not guaranteed until formal appro�al by City Council, as <br /> outlined in Section 66458 of the Subdivision Map Act, and Section 3�.55 of the City's <br /> Municipal Code. <br /> The developer, RC Peninsula Park , LLC, is in the process of developing the site. �ans <br /> developer's engineer, KPFF of San Francisco has compieted the �mprovement p <br /> entitled "Bair Island Road Improvements", in accordance with the City's �rdinances and <br /> the Precise Plan. The improvement plans are for Phase I only, which is approximatel�y <br /> 3�% of their frontage. Future phases will be submitted for approval to Ctty Counc�l aost <br /> amendments to the agreement will be requ�red. The developer is requ�re�d to p <br /> Faithful Performance and Payment Bonds, each in the amount of$1,893,903 <br />
