must be kept accurate and current. Developer shall cause records to be accurate and current and <br />in such a form as to allow the City to comply with the record keeping requirements contained in <br />24 C.F.R. 570.506. Such records are to include but are not limited to: <br />(i) Records providing a full description of the activities undertaken with the use of <br />the Loan funds; <br />(ii) Records demonstrating that the HOME Funds have been used in compliance with <br />HOME Program requirements; <br />(iii) Records demonstrating compliance with the HUD property standards and lead- <br />based paint requirements; <br />(iv) Records documenting compliance with the fair housing and equal opportunity <br />requirements; <br />(vi) Financial records as required by 24 C.F.R. 570.502, and OMB Circular A-110 (24 <br />C.F.R. Part 84); <br />(vii) Records demonstrating compliance with the HOME Program tenant selection, <br />affordability and income requirements; <br />(viii) Records demonstrating compliance with MBE/WBE requirements; <br />(ix) Records demonstrating compliance with 24 C.F.R. Part 135 which implements <br />section 3 of the Housing Development Act of 1968; <br />(x) Records demonstrating compliance with applicable relocation requirements, <br />which must be retained for at least five (5) years after the date by which persons displaced from <br />the property have received final payments; <br />(xi) Records demonstrating compliance with labor requirements including certified <br />payrolls from Developer's general contractor evidencing that applicable prevailing wages have <br />been paid; and <br />(xii) Other records necessary to document compliance with Subpart K of 24 C.F.R. <br />Part 570. <br />3.4 Access to Records. Inspections. <br />3.4.1 The City shall notify the Developer of any records it deems insufficient. <br />The Developer shall have fifteen (15) calendar days after the receipt of such a notice to correct <br />any deficiency in the records specified by the City in such notice, or if a period longer than <br />fifteen (15) days is reasonably necessary to correct the deficiency, then the Developer shall begin <br />to correct the deficiency within fifteen (15) days and correct the deficiency as soon as reasonably <br />SF #4821-4436-6284 v2 <br />1619\01\3064651.1 <br />REV: 05-19-2021 SK <br />
