Developer shall cause records to be accurate and current and in such a form as to allow the City to comply with the record keeping requirements contained in 24 C.F.R. 570.506. Such records are to include but are not limited to: (i) Records providing a full description of the activities undertaken with the use of the Loan funds; (ii) Records demonstrating that the HOME Funds have been used in compliance with HOME Program requirements; (iii) Records demonstrating compliance with the HUD property standards and lead- based paint requirements; (iv) Records documenting compliance with the fair housing and equal opportunity requirements; (vi) Financial records as required by 24 C.F.R. 570.502, and OMB Circular A-110 (24 C.F.R. Part 84); (vii) Records demonstrating compliance with the HOME Program tenant selection, affordability and income requirements; (viii) Records demonstrating compliance with MBE/WBE requirements; (ix) Records demonstrating compliance with 24 C.F.R. Part 135 which implements section 3 of the Housing Development Act of 1968; (x) Records demonstrating compliance with applicable relocation requirements, which must be retained for at least five (5) years after the date by which persons displaced from the property have received final payments; (xi) Records demonstrating compliance with labor requirements including certified payrolls from Developer's general contractor evidencing that applicable prevailing wages have been paid; and (xii) Other records necessary to document compliance with Subpart K of 24 C.F.R. Part 570. 3.4 Access to Records. Inspections. 3.4.1 The City shall notify the Developer of any records it deems insufficient. The Developer shall have fifteen (15) calendar days after the receipt of such a notice to correct any deficiency in the records specified by the City in such notice, or if a period longer than fifteen (15) days is reasonably necessary to correct the deficiency, then the Developer shall begin to correct the deficiency within fifteen (15) days and correct the deficiency as soon as reasonably SF #4821-4436-6284 v2 1619\01\3064651.1 REV: 05-19-2021 SK
