<br />(b) Providing that Contractor's insurance will apply separately to each
<br />insured against whom claim is made or suit is brought, except with respect
<br />to the limits of the insurer's liability (cross liability endorsement);
<br />(c) Naming the City of Redwood City, its Council, officers, boards,
<br />commissions, employees, and agents, as additional insureds; and
<br />(d) Providing that Contractor's insurance coverage will be primary
<br />insurance with respect to City, its Council, officers, boards, commissions,
<br />employees, and agents, and any insurance or self-insurance maintained by
<br />City for itself, its Council, officers, boards, commissions, employees, or
<br />agents shall be in excess of Contractor's insurance and not contributory with
<br />it.
<br />16. NON-DISCRIMINATION AND EQUAL OPPORTUNITY. Contractor
<br />warrants and agrees it will not discriminate against any persons seeking services or
<br />employment under this agreement because of their age (40 and above), physical or
<br />mental disability, marital status, race, color, national origin or ancestry, veteran status,
<br />religion, sex, pregnancy, childbirth or related medical conditions, gender (including
<br />gender identity and gender expression or perception), sexual orientation, medical
<br />condition, use of family medical leave, or genetic testing, in the provision of services or
<br />extension of employment opportunities under the Agreement. Contractor further warrants
<br />and agrees that it will comply with all relevant local, state and Federal non-discrimination
<br />ordinances, statutes, regulations, and executive orders pertaining to non-discrimination
<br />and equal opportunity, including but not limited to, Title VI of the Civil Rights Act of 1964
<br />as amended, Title VIII of the Civil Rights act of 1968 as amended, Section 104(b) and
<br />Section 109 of Title 1 of the Housing and Community Development Act of 1974 as
<br />amended, Section 504 of the Rehabilitation Act of 1973, The Americans with Disabilities
<br />Act of 1990, the Age Discrimination Act of 1975, Executive Order 11063 as amended by
<br />Executive Order 12259, and Executive Order 11246 as amended by Executive Orders
<br />11375, 11478,12086, 12106, 13087, 13152, and 13672, 24 CFR Section 570.607, as
<br />revised by Executive Order 13279. Contractor will include a statement that it is an equal
<br />opportunity employer in all solicitations or advertisements for subcontractors or
<br />employees.
<br />17. NONDISCRIMINATION IN THE PROVISION OF SERVICES
<br />A. Contractor hereby agrees that it will comply with the provisions of the
<br />American with Disabilities Act (ADA) providing equal access and reasonable
<br />accommodations in employment programs and services to persons who are
<br />disabled and, if applicable, with Section 504 of the Rehabilitation Act of 1973.
<br />B. Contractor hereby agrees that in the provision of services and Program
<br />activities, it will comply with all applicable local, state and federal laws and
<br />regulations prohibiting discrimination and harassment.
