Code §27383 <br />LANDSCAPE MAINTENANCE AGREEMENT <br />(101 Westpoint Harbor Drive Phase 3) <br />THIS LANDSCAPE MAINTENANCE AGREEMENT {"Agreement"} is made and <br />entered into this I�day of �8� , 2021 ("Effective Date"), by and between <br />Westpoint Harbor LLC, a California limited liability company ("Developer"), and the CITY <br />OF REDWOOD CITY, a charter city and California municipal corporation ("City") <br />(together, the "Parties") with reference to the following facts: <br />RECITALS <br />A. Developer is the current fee owner of that certain real property consisting of <br />approximately 50 acres located within the City of Redwood City, County of San Mateo, <br />State of California, described in Exhibit "A", attached hereto and incorporated herein by <br />reference (the "Property"). <br />B. On July 16, 2020, the Zoning Administrator of the City of Redwood City <br />adopted, among other approvals, Architectural Permit AP2019-044, approving a <br />restaurant, clubhouse, pool and pool house, and parking area, on the Property subject to <br />certain conditions of approval ("Conditions"). <br />C. In compliance with the Conditions, Developer submitted to City landscaping <br />plans for the Property ("Plans"), which have been approved by City. The Plans provide <br />for installation of certain landscaping, street lighting, irrigation, and paths <br />("Improvements") within and adjacent to the access road and parking area ("Maintenance <br />Area") as the Improvements and Maintenance Area are more specifically shown on <br />Exhibit "B" attached hereto and incorporated by this reference as if fully set forth herein. <br />D. City and Developer desire to enter into an agreement pursuant to which <br />Developer will maintain the Improvements within the Maintenance Area as both are <br />depicted on Exhibit "B". <br />AGREEMENT <br />NOW, THEREFORE, in consideration of the faithful performance of the terms and <br />conditions set forth in this Agreement, the Parties hereto agree as follows: <br />REV: 11-05-2021 VR <br />ATTY/AGR2021.281NVestpoint Harbor, LLC (Page 1 of 12) <br />
