Permittee shall use the Property solely for the purpose of <br />and for no other purpose whatsoever (the 'Permitted Activity'). Permittee shall not use the Property to <br />transport or store materials, Including, without limilation- any Hazardous Substances, as defined in <br />Special Provision 16, below. <br />2, Permillee shall not use or permit the use of the Property in any manner that would tend to create waste <br />or a nuisance or in a way that oompromises the public health, safety, or welfare, or the publids use of the <br />right•cf-way <br />3. All of Permitleri s Activities shall be performed at Petmittee ; safe coat, risk and expense. Except as <br />expressly provided herein, this Permit does not entille Permitlee to install any improvements on the <br />Property. <br />4. Pemitlee expressly acknowledges and agrees that City has no obligation to maintain or repair the <br />Property, or the improvements located thereon, and Permittee accepts use of the Property in its AS -IS <br />condition. Perrnihee acknowledges that it has inspected the Property and Permillee warrants and agrees <br />that it is thoroughly familiar with the Property and all aspects thereof, including, without limilation, the <br />physical condition of the Pmpedy, the zoning of the Property, and all other restrictions and limitations <br />applicable to the Property (whether or not of public record)- Permittee acknowledges and agrees that the <br />Property i5 satisfactory to Permiflee in all respects. Permillee agrees that neither City nor anyone acting <br />on City's behalf has made any representation at warranty of any kind or nature whatsoever respecting <br />the condition of the Properly, its suitability for Permitlee's intended use, or any other, matter relating to <br />the Property (including, but not limited to, the environmental condition of the Properly) or this Permit, and <br />Permittee agrees that it is taking the Properly under this Permit in its `AS4S CONOMON AND WITH <br />ALL FAULTS". <br />5, This Permit 4 not intended to nor shall it be interpreted to create or vest in Permtltee any tranchise, <br />leasehold, or any other property rights or interests in the Properly, or the improvements located therean, <br />or any part thereof.
