RECORDING REQUESTED BY <br />AND WHEN RECORDED RETURN TO: <br />City of Redwood City <br />1017 Middlefield Road <br />Redwood City, California 94063 <br />Attn: City Clerk <br />(Space above this Line for Recorder's Use Only) <br />Public Access Easement Deed <br />THE UNDERSIGNED GRANTOR DECLARES AS FOLLOWS: <br />The undersigned declares that this Grant Deed is exempt from Recording Fees pursuant <br />to California Government Code section 27383 and exempt from Documentary Transfer <br />Tax pursuant to California Revenue and Taxation Code section 11922. <br />FOR A VALUABLE CONSIDERATION, receipt of which is hereby acknowledged, GS <br />HIP 1304 ECR, LP (Grantor) hereby GRANT(s) to the City of Redwood City, a charter <br />city and municipal corporation (Grantee), a permanent non-exclusive easement in and to <br />that certain real property in Redwood City, County of San Mateo, State of California as <br />more particularly described in Exhibit A and shown on Exhibit B, attached hereto and <br />incorporated herein by this reference. The parcel of real property described in Exhibit A <br />and shown on Exhibit B shall be used for the purpose of a public access easement for <br />pedestrian access and be kept free and clear of buildings and structures of any kind; <br />provided, however, that overhangs, awnings, and other similar improvements shall be <br />permitted to exist over and above the easement area so long as such improvements do <br />not unreasonably interfere with the purposes set forth herein. The provisions of this Deed <br />are intended to and will run with the land, and, until their expiration or termination in <br />accordance with the terms of this Deed, will bind, be a charge upon and inure to the <br />benefit of Grantor and Grantee, their respective successors and assigns. <br />THE PURPOSE(S) OF THE EASEMENT shall be for the right of ingress and egress for <br />public purposes over, along, upon, under and across the parcel of real property described <br />in Exhibit A and shown on Exhibit B. Said parcel to be kept open and free from buildings <br />and structures of any kind. <br />GRANTOR FURTHER GRANTS TO GRANTEE the right to: <br />1. Grant said easement or a portion thereof to other public utilities or public agencies; <br />and <br />2.
