In my capacity, I have been <br />made aware of a Public Records Act request submitted by Mike <br />Elhihi on September 9, 2021. I have also reviewed the responsive <br />documents and communications between City staff and Mr. Elhihi <br />related to his request for documents. The City’s last communication <br />on the issue came on October 20, 2021 from the City Clerk’s Office <br />stated: “Upon further review of your public records request <br />received on September 9, and follow-up request on October 5, the <br />City has identified responsive records, however those records <br />continue to be exempt pursuant to Government Code Section <br />6254(a). This determination has been made by the City Clerk, in <br />consultation with the City Attorney. To the extent you have <br />information requests related to labor negotiations between the City <br />and IAFF, please submit such requests in writing to the City <br />bargaining team, pursuant to the formal process established <br />between the parties.” Government Code Section 6254 reads as <br />follows: “Except as provided in Sections 6254.7 and 6254.13, this <br />chapter does not require the disclosure of any of the following <br />records: a. Preliminary drafts, notes, or interagency or intra- <br />agency memoranda that are not retained by the public agency in the <br />ordinary course of business, if the public interest in withholding <br />those records clearly outweighs the public interest in disclosure.” <br />IAFF is aware of emails exchanged between City employees that are <br />responsive to the records request and that could not possibly be <br />exempted under the 6254(a) exception.
