RESOLUTION NO. 16021 r...,., .. 4 r ,.: ;•,, ..:; <br />1 - 4:�74::.Lk� eiLY � � 3 . . ii' :.I R•i'f : f 1f <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY :OF:.REDWO.OD, <br />CITY SUMMARILY VACATING A PUBLIC SERVICE EASEFAENTA <br />LOCATED AT 783-785 BROADWAY IN THE CITY OF REDWOOD-GFT-Y <br />PURSUANT TO PART 3 OF DIVISION 9 OF CHAPTER 4 OF THE <br />CALIFORNIA STREETS AND HIGHWAYS CODE <br />WHEREAS, pursuant to the provisions of Part 3 (commencing at Section <br />8300) of Division 9 of Chapter 4 of the California Streets and Highways Code, the <br />City Council of the City of Redwood City ("City Council"), is authorized to <br />summarily vacate the public service easement located 783-785 Broadway, <br />located as shown on the Subdivision Map "Redwood Industrial Tract No. 2" in <br />Book 35 of Maps, at Pages 3 through 6, in the office of the Recorder for the County <br />of San Mateo; and <br />WHEREAS, that public service easement to be vacated is an easement for <br />spur track only and described in Exhibit A ("Spur Track Easement")and shown on <br />Exhibit B ("Vacation Area"), attached hereto and incorporated by reference; and <br />WHEREAS, the Spur Track Easement is a public service easement under <br />Streets and Highways Code section 8340; and <br />WHEREAS, the Spur Track Easement has not been used for the purpose for <br />which it was dedicated for five consecutive years immediately preceding January <br />2022; and <br />WHEREAS, no other public facilitates are located within the Spur Track <br />Easement; and <br />WHEREAS, the Spur Track Easement has been determined to be excess by <br />the City; and <br />WHEREAS, summary vacation of the Spur Track Easement is appropriate <br />consistent with Streets and Highways Code section 8333 subsections (a) and (c). <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY <br />OF REDWOOD CITY AS FOLLOWS: <br />1. The recitals set forth above are true and correct, and are hereby <br />incorporated herein by this reference as if fully set forth in their entirety. <br />2.
